Virginia Western Community College adheres to the policies of the Virginia Community College System (VCCS) relative to intellectual property, copyright issues, and revenue derived from the creation of intellectual property. VWCC policy incorporates all aspects of the VCCS policy found in Section 12 of the VCCS Policy Manual and the Intellectual Property Guidelines established by the State Council of Higher Education for Virginia (SCHEV) as mandated by the Code of Virginia Sections 23-4.3, 23-4.4 and 23-9.10:4.
In accordance with VCCS policy, the president, or his designee, is responsible for administration of this policy at the college level. The college’s Intellectual Property Administrator (IPA) is appointed by the president and assisted by a college’s Intellectual Property Committee (IPC) in implementing the provisions of VWCC and VCCS policies. Disputes may be appealed to the IPC. The IPC will hear and adjudicate any disputes concerning the administration of the intellectual property policy. Should there be an appeal beyond the IPC, that appeal will go to the college president, or designee (Vice President of Academic and Workforce Solutions if related to the academic areas or Vice President of Facilities and Finance if related to technology other than that which is academic), whose decision is final. The president may choose to refer the issue to the VCCS System Attorney.
In order to further add protection to the college in these matters, the college will maintain a License with Broadcast Music, Inc. (BMI) which affords the college the use of any or all of the more than 6.5 million musical works in the BMI Repertoire and protects the rights of songwriters, composers and music publishers and a license with ASCAP which affords the college access to over 8.5 million works and ensures compliance with the U. S. Copyright Law. An ASCAP License Agreement supplies blanket permission to perform copyrighted works in public.
