Purpose:
To set forth practices regarding outside employment. This policy also addresses when conflicts arise or injuries occur in the course of the outside employment.
Definitions:
Employee – All persons employed by the college.
Outside Employment – Any gainful employment, including self-employment and employment at other state agencies, that is in addition to the position held at the college.
Policy:
When a college employee obtains outside employment, it is not the intention of the college to control employees after they have fulfilled their responsibilities to their position at the college. It is expected, however, that the employee recognize that their position at the college has precedence over the outside employment in the event conflicts arise in job performance, scheduling, attendance and other work-related matters. Additionally, as a state employee funded by the taxpayers of Virginia, it is the college’s obligation to ensure that when an employee is working with an outside employer, that this position does not pose a conflict of interest in accordance with the Code of Virginia.
If an employee desires to seek or engage in outside employment, the employee must submit a VWCC Outside Employment Request Form for approval to their supervisor prior to accepting the additional job. Final approval from the associate vice president of Human Resources must be received before accepting the outside employment.
After beginning the outside employment, should the employee’s job performance begin to deteriorate and/or work-related conflicts arise, the supervisor should ask the employee to voluntary give up their outside employment to focus fully on their position with the college.
The employee may be subject to disciplinary action if:
- The additional employment is accepted without receiving prior approval; or
- the employee is conducting outside employment during work hours; and/or
- declining job performance, including in part attendance and/or other work-related conflicts, occurs.
Supervisors and employees must adhere to and abide by all established applicable policies and procedures.
Workers’ Compensation
Any injuries sustained with the outside employer does not fall under the umbrella of the college’s Workers’ Compensation Program.
VWCC Outside Employment Request Form
The VWCC Outside Employment Request Form is located within the procedure for Outside Employment for Employees. Employees may also request this form from their academic school, department, or by contacting or visiting Human Resources.
